Web online lesson contract
The Earth Plan Learn Japan Co., Ltd. (Hereafter, Company) exchanges the contract with the Language Instructor (Hereafter the Instructor) as follows.
The online lesson, in this case, means that the instructor gives interactive language lessons to the students of the company on his/her own personal computer by using the system the Company offers.
Procedure
1. The Instructor inputs his/her personal history (resume) into the digital application form the Company offers.
2. After examining his/her resume and exchanging e- mail, the Company arranges an interview by online telephone with video, and then decides whether to employ the instructor.
3. The identification number and the password that can be used to log in are e-mailed to the instructor by the Company.
4. The instructor inputs his/her profile, a photo and decides their price to be put into the Company's system.
5. The instructor is required to prepare a web camera, a head phone set and a whiteboard.
Textbooks
Instructor uses the textbooks that the Company provides.
Instructor can decide whether he/she uses the textbooks in the lesson or not by consulting with the student in the trial lesson (interview).
If the student wants to have a free-talking lesson, the instructor need not use textbooks in the class.
Cost of the textbook
When the first lesson starts, the Company pays only half of the cost of the textbook to the instructor. Whenever the instructor gets a newly registered student, the Company refunds 10% of the original cost. This is repeated up to 5 new students to completely cover the cost of the teacher's textbook.
Regular, trial lesson & support fee
The instructor can set the fee for the regular class.
The rates for services outside of language conversation lessons, (interpreting, translating, and checking e-mail or other assistance) should be decided upon by the instructor based on the support being done and the time it takes to complete. The instructor can refer to the list of fees Company provides if needed.
The company pays 50% of the fees for regular lessons, interpreting, translating, checking e-mail or other assistance.
The trial lesson fee is set at \300 per lesson.
The Company pays the full amount for the trial lesson to the instructor.
Monthly wages are calculated based on a time period beginning the first day of each month, and ending on the last day of the month, made payable to the instructor's bank account on the twentieth (20th) day of the following month. In the event that the 20th day falls on a holiday, wages shall be paid on the day before.
Lesson schedule
The instructor submits the lesson schedule 30 days in advance.
When the Company accepts the reservation for a trial lesson from potential student, Company sends an e-mail to both the instructor's personal computer and cellular phone at the same time.
The instructor should prepare the lesson plan and material he/she will use before the teaching.
The students can change the lesson schedules up until 24 hours before the lesson.
In the case a student cancels the lesson just before the appointed date, the Company pays the fee for one lesson.
The Company will send an e-mail to the instructor 3hours before and 1 hour before lessons to confirm the lessons.
The instructor can change the lesson schedule without reservation up until 24 hours before. No changes can be made within 24 hours of a lesson.
The instructor cannot change a lesson schedule which was reserved by a student.
The Company doesn't pay the fee for lessons that were cancelled or forgotten by the instructor.
If the instructor inflicts the extensive damage on the Company's reputation, the following penalty is imposed.
First, the instructor must give free lessons to the students whose reservations were missed by the instructor, in addition to making up the missed lessons.
Secondly, the Company deducts the amount of one posted lesson fee (the amount the student pays, not the percentage the instructor gets), for the student from the instructor's monthly payment.
Thirdly, this contract will be expired in the case the instructor cancels reserved lessons twice.
When the lesson cannot be done for any of the following reasons, it should be changed to another day.
1.
It is impossible to do the lesson due to communication problems, i.e. trouble caused by both of the users' communication environments, computer environment, Internet connection, connection status, etc.
2.
The lesson is cancelled temporarily due to system failure.
3.
The trouble is caused by the international Internet line, a domestic political situation, natural damage/disasters, or the Internet system.
Regulations
Do not give lessons directly to the student (i.e. without company knowledge) after signing this contract.
Do not negotiate with the student about fees or discuss private matters that are not related to the lessons.
If this contract is not fulfilled, both the Company and the instructor can cancel it.
If this contract is taken into a court of law, the Gifu District Court is assumed to be a competent court.
Any matters which are not written in this contract should be decided on during the meeting between the Company and the instructor.
